K-1 Visa Interview Issues

The climax of the US visa process is the K1 visa interview. This phase of the process may be the most anticipated, second only to the approval phase. In many ways, a US visa lawyer can be helpful in assisting a Thai with the fiance visa interview.

401(k) Rollover to Your Retirement Wealth

1) You can also "transfer" the money directly to the new custodian and this transaction is not reported to the IRS and less paperwork will be required at tax time.

If you receive the money directly, you will have 60 days to deposit it into another custodial account. If you deposit it after the 60 day period, you may be subject to penalties.

Use Charts to Invest Confidently Within Your 401(K)

Comparing investment choices within your plan's list of stocks or funds can be done simply and quickly. Do you need a mid-cap fund in your portfolio and have three to choose from? Put the charts up side-by-side and compare their performance to each other. Pull up a chart of the S&P 500 and see which of the three performed better compared to the overall market. Some charting services even give you the ability to layer one chart atop another to make the comparisons really easy.

Perhaps the real beauty of using charts in your research is this: if you make an investment mistake, you will know it pretty quickly. Charts, like all other investment tools, are not 100% accurate in forecasting market direction. Good Sources Of Vitamin K

There are many good sources of Vitamin K, including both plants and animals. However, the quality of the Vitamin K differs substantially between them, since plants produce mainly the K1 (phylloquinone) form while animals produce the K2 form (menaquinone).

It is important to know that Vitamin K1 is not nearly as bio available as Vitamin K2. First, it is not absorbed nearly as well, and second it is not as effective in the cells of the body at doing its primary function, which is activating certain proteins and enabling them to bind calcium.

The types of animal food that are rich in K2 include meats, eggs and organs. These contain a much higher amount if the animals are grass fed, therefore it is always better to get grass fed meat if it is available and isn't more expensive than what you are comfortable with.

The best out of all the sources of vitamin K is high fat dairy. This is where us western humans get the majority of our Vitamin K from, and this is the superior animal form (K2). High fat dairy includes cheese, cream and butter, where grass fed butter or butter oil is the richest source.

There was a study done on people, comparing their consumption of high fat dairy (among other things). What the researchers found was that those who ate the most had a 69% less chance of developing heart disease than those eating the least. To put this into context, heart disease is the worlds number one killer.

If you eat a lot of gluten grains, then they may interfere with fat soluble vitamin absorption and therefore it might be best to minimize them. It is also important to eat fat in order to be able to absorb Vitamin K and other fat soluble nutrients.

One of the sources of Vitamin K that we never run out of is the bacteria in the intestine. They actually produce so much that an actual Vitamin K deficiency is extremely rare, and it is pretty much unheard of except in infants who haven't had their large intestine colonized yet. K-1 Fiance Visa Holders Retain Legal Rights After Divorce

Noncitizens who enter the United States on a K-1 fiance visa may retain their residency rights as two cases in the Ninth Circuit Court of Appeals have recently upheld. The Immigration and Naturalization Service (INS) has held that K-1 fiance visa holders can only adjust their status to permanent resident if their marriage is still intact at the time of adjustment.

This understanding is in line with the Immigration Marriage Fraud Act of 1986, which was enacted to prevent fraudulent marriage-based immigrants. But the Ninth Circuit Court said that the statute does not change the need for a lasting marriage, but interprets that marriage is entered in "good faith".

Jelena Choiniere the United States with a visa to marry her boyfriend Mr. Albert Tapia K -1. After being married, Choiniere has submitted an application to change their permanent resident status with the INS.

In the two years that ChoiniereApplication idled in the bureaucracy of the INS, and divorced Choiniere Tapia. The INS denied the application Choiniere then why are not married at the time of adjustment and the sentence was set to be removed from Homeland Security.

Similarly Natalya Strokous woman arrived in the U.S. with a visa to marry her boyfriend K -1 Borus Mr. Bengel. They divorced Strokous first submitted their application was on his permanent change of residence due to his marriage to Bengel.Because she had not filed her application before their divorce, the initial court denied her application and ordered her removal from the United States.

But the Ninth Circuit Court has responded that the statute does not outline a duration for the marriage requirement but rather interpreted that the marriage be entered into in "good faith." The Ninth Circuit Court ruled that no duration for marriage was stipulated in the statute.

As long as the marriage contract was entered into in good faith and the application for status adjustment had been filed, the Court ruled that marriage at the time of the ruling in Choin's case was irrelevant. Based upon Choin's case, the Ninth Circuit Court upheld that even though Strokous had filed to adjust her status after her divorce, the Court ruled that even if a marriage ends in divorce. It in no way implies that the marriage was not entered in in good faith.

This is good news and legal recourse for immigrants who have attained legal status as a result of a K-1 fiancé visa and wish to retain legal rights within the United States after a marriage ends in divorce [http://www.totaldivorce.com].

No duration for marriage is outlined so long as the Court interprets that indeed it was entered into in good faith. The boundaries for a Court's interpretation are certainly fuzzy in terms of assessing "good faith," but legal precedent has been established that immigrants under K-1 fiancé visas may attain legal permanent residency after their marriage ends in divorce regardless if the INS has approved the application for permanent residency.

This is good news for immigrants who enter into good faith marriages though it does open the possibility for fraudulent immigrant-based marriage, the motive behind the Immigration Marriage Fraud Act.

FHA 203(k) Program - Additional Funds For Property Rehabilitation

The Section 203k Program is FHAs primary program for the rehabilitation and repair of single family properties. It has been a great tool for community and neighborhood revitalization. Many lenders have successfully used the program to help borrowers purchase and rehabilitate properties.

How it Works:

Typically when a homebuyer wants to purchase a home in need of repair or modernization, the buyer will normally need to obtain financing to purchase the dwelling; then additional financing for the repairs/construction; and finally a permanent mortgage when the work is complete to pay off the original loans involved.

With the FHA 203(k) program, the borrower can obtain a single long-term mortgage loan to finance both the acquisition and the rehabilitation of the property. In order to provide the funds the mortgage amount is based on the projected value of the property with the work completed, taking into account the cost of the work.

When the loan closes, the proceeds for the rehabilitation/improvement will be placed into an interest bearing escrow account insured by the FDIC or the NCUA. The lender will release these funds upon completion of the proposed rehabilitation in accordance with the Work Write-Up and the Draw Request.

Example: $20,000 in repairs is needed on a home where the purchase price is $200,000. The total mortgage amount would be $220,000. $200,000 goes to the actual sale, while the remaining $20,000 is placed into an escrow account and will be paid out once the work is complete.

Property Eligibility:

The property must be a one to four-family dwelling that has been completed for at least one year. The number of units on the site must be acceptable to the provisions of local zoning requirements. All newly constructed units must be attached to the existing dwelling.

Homes that have been demolished or will be razed are eligible provided some of the existing foundation system remains. The program can also be used to converts a one-family dwelling into a two, three, or four-family dwelling, and vice versa. An existing home (modular unit) on another site may be moved to the mortgaged property.

Eligible Improvements:

All repairs/construction must comply with the following:

1. New construction must conform to local codes and HUD Minimum Property Standards

2. To improve the thermal efficiency of the dwelling, the following are required:

-Weather-strip all doors and windows

-Caulk or seal all openings, cracks or joints.

-Insulate all openings in exterior walls where the cavity has been exposed.

-Insulate ceiling areas where needed.

3. Replacement Systems

-Heating, ventilating, and air conditioning system supply and return pipes and ducts must be insulated whenever they run through unconditioned spaces.

-Heating systems, burners, and air conditioning systems must be sized to be no greater than 15% oversized for the critical design, heating or cooling, except to satisfy the manufacturer's next closest nominal size.

4. Each sleeping area must be provided with a minimum of 1 approved, listed and labeled smoke detector installed adjacent to the sleeping area.

Luxury items and non-permanent improvements are not eligible. However the program may be used for such things as painting, room additions, decks and other items even if the home does not need any other improvements.

Required Exhibits:

The homebuyer must provide the lender with the appropriate architectural exhibits that clearly show the scope of the work to be completed.

The flowing are recommended exhibits, but may be modified by the local HUD Field Office:

-A plot Plan of the site is required only if a new addition is being made.

-Proposed Interior Plan of the Dwelling shows where structural or planning changes are contemplated.

-Work Write-up and Cost Estimate. Any format may be used, but the quantity and cost of each item must be shown. Cost estimates must include labor and materials sufficient to complete the work by a contractor.

What to Do About Your 401(k)

Is it time to throw in the towel on your 401(k) plan?  Over the last year, more than $1 trillion dollars has simply evaporated.  Many investors saved diligently for years.  They're now looking at account balances down by 40% or more.  With no end in sight to this grizzly of a bear market, millions of Americans are feeling the overwhelming urge to pull the plug on their 401(k)s.

Take the case of one of my good friends.

John is a prime example of the perfect saver.  A 40 year old software engineer, he started contributing to his company's 401(k) plan at the age of 22.  He steadily increased his contributions over the years as his income grew.  His investments are diversified.  And, he stuck to his plan through good times and bad (even the bursting of the dot com bubble in 2000).

John called me in a panic.

His 401(k) has lost almost $180,000 in the past year.  To make matters worse, his employer recently announced a round of layoffs.  He's gone from being on pace for an early retirement to possibly not retiring at all. The abject fear in his voice sent shivers down my spine.

He fired off several questions in rapid succession.  

Should he keep making contributions?  Should he move everything into cash?  Should he take a loan from the account to pay down his debts?

This is what I told him.

401(k) Tip #1:  Make a plan.

Everyone should have a sound plan for achieving their retirement goals. If you don't know how much money you need for retirement, you can't possibly know how much to save or how to invest it.  And, when times are tough, your plan will help you evaluate the damage to your portfolio.

401(k) Tip #2:  Keep making regular contributions and increase them if you can.

The worst time to stop contributing to your 401(k) is when the market is down.  Think about it.  When the price of gas falls, do you stop filling up your car?  No.  If anything, you fill up more often before prices go back up.

The same principle applies to your 401(k).  You want to keep adding to your investments (and buy more if you can) while they're selling at a discount.  Lower prices mean you can buy more shares with the same contribution.  This lowers your average cost basis and sets you up for bigger returns when the market recovers (and trust me, it will recover).

401(k) Tip #3:  Review your asset allocation.

The foundation of your retirement plan is your asset allocation strategy. This is the optimal mix of stocks, bonds, and cash for your portfolio.  The right mix for you depends on your specific goals, time horizon, and tolerance for risk.  Research shows more than 90% of your long-term investment returns are determined by your asset allocation.

Right now is a critical time to review your asset allocation.  While your gut's saying sell out of stocks entirely, your asset allocation might say to buy more.  Following a sound asset allocation strategy will bring discipline to your decision-making and better long-term returns.

401(k) Tip #4:  Diversify your investments and keep costs down.

As the old saying goes, "don't put all your eggs in one basket."  Spread your investments across several different mutual funds.  Diversify by size of company through large-cap, mid-cap, and small-cap stock funds.  Get exposure to both growth and value investment styles.  And, don't forget to include an international fund.

Keep your costs down by selecting funds with lower expense ratios.  The expense ratio pays for management fees and marketing costs.  Don't give away more of your money than you have to.

Index funds will have the lowest expenses because they're not actively managed.  Expense ratios for small-cap and international funds are higher on average than those for large-cap domestic stock funds.  As a general rule, you shouldn't pay more than 1.5% for a stock fund.

401(k) Tip #5:  Don't move all of your assets into cash just because the market is down.

I know it's scary to see huge losses on your account, but selling out when the market's down is a catastrophic mistake.  Right now those losses are on paper.  If you sell out, you lock those losses in forever.  If retirement is still years or decades away, you have plenty of time for your portfolio to recover.

401(k) Tip #6:  Borrow from your 401(k) only as a last resort.

In these tough economic times, the temptation to borrow from your 401(k) can be overwhelming.  My advice is to first exhaust all other options.  And, make sure the purpose of the money is important enough to justify raiding your retirement plan.

Consider the consequences of taking the loan.  Every dollar you take out of your plan is one less dollar providing tax-deferred growth.  If you fail to repay the loan or make the scheduled interest payments, the loan could be treated as taxable income.  And, some plans require borrowers to suspend making contributions to their plan for a period of time.

After I passed on my 401(k) tips, John felt a lot better about his situation.  He's going to review his plan, assess the damage to his portfolio, and make reasonable adjustments.  He's also going to explore other options for paying down his debts before taking a loan from his    401(k).

The other day, I received an email from someone who wanted to know if it was really necessary to order the medifast shakes online.  She had made the decision to diet, wanted to get started right away, and asked me, in part:  "what's to stop me from just buying one of the protein shakes at the grocery store and then getting the same results?  Let's just use the new special K protein shakes as an example.  What makes the one of the shakes different (or better) than the other?" I'll answer these questions in the following article.

K-Line Model Trains

Back in 1970 there was a great war between the model train makers. Companies rose and fell with regularity, such as railways business model was key. One of the names to come out this time, K-Line.

Solo IRA's & Solo 401(K)'s - What They Are Used For & Their Differences

If you are self-employed (S.E.) or a business owner you may have heard of a Solo IRA or Solo 401(K). But do you know the differences? Solo 401(K)'s are sometimes referred to as a Solo K or S.E. 401(K). When you get your federal income tax return, Solo IRAs are listed as SEP-IRA (simplified employee pension) or a broker may call it a SEP. I will explain the differences between the two, along with the pros and cons of each.
 
Only people who are self-employed and/or business owners and their spouses, are allowed to open a Solo IRA, whether they have employees or not. You and your spouses can also open a Solo 401(K), but only if you have no employees who get a W-2. So for example, if you own a restaurant and have employees, you would not be eligible to open a Solo 401(K). Although you can hire out (outsource) help as contractors, etc., because these people are in business for themselves and do not get a W-2 from you along with their pay. Solo IRA's & Solo 401(K)'s can also be 'self-directed' as well.
 
As with any form of investing for retirement, there are rules or guidelines governing Solo IRAs and Solo 401(K)'s. For instance, Solo IRAs can only be a Traditional account (Traditional Solo IRA), and not a Roth. Anyone can have a Roth IRA, whether they are self-employed and/or business owners or not. Many self-employed people and business owners have both, a Roth IRA, and either a Solo IRA or Solo 401(K).
 
Solo IRA and Solo 401(K) contributions are tax-deductible, which means taxes on contributions are not paid until funds are withdrawn at retirement. But there are differences between the two. Solo 401(K)'s have a higher yearly limit on contributions and they require much more paperwork involvement. So it may be difficult to find a company or broker that offers this service. The yearly allotted contributions for both a Solo IRA and Solo 401(K) changes yearly. So Do Your Homework! With Solo IRAs and Solo 401(K)'s, the maximum allotted yearly annual contribution per couple in 2008 was over $100,000. Solo IRAs and Solo 401(K)'s carried the highest maximum contribution dollar amount of any contribution investments, but it is based on a percentage of income or company profits.
 
For example, a Roth IRA only allows for a maximum annual yearly contribution of $10,000 per couple, or $5,000 per individual and will continue to increase $500 a year starting in 2009 due to inflation. You can read up more on Roth IRAs, self-directed IRA's, and self-directed 401(K)'s at ezine articles online under author Colleen K. So as you can see, if you are a self-employed and/or a business owner and your yearly income is higher, you benefit by having a higher annual yearly contribution dollar amount. The downside to Solo IRAs and Solo 401(K)'s, is that they are not tax-deferred, and therefore you pay taxes on distributions at retirement (higher dollar amount), versus paying taxes on contributions now (lower dollar amount), and do not benefit from having contributions at retirement distributed tax-free.

If you are taking bacteria for a certain illness you need to make sure the strain of bacteria is appropriate for the sickness because there are different quantities of bacteria needed for different illnesses.

Bio-K is one of the more costly of the probiotics on the market, but as explained by the rep., a lot of probiotic have bacteria that die before they are even consumed but not so with Bio-K. It is costly but it is a good product so whenever I get sick I take a tablespoon a day. There are cheaper versions out there but I definitely recommend regularly including probiotics in the health regime.

401K Plan Vesting - Fully Vested 401K Account Balance

A 401k plan is a wonderful chance for employees and employers to contribute money to a retirement account. When considering participation, the vesting period or the point where the account and balance is fully vested should be understood.

To be 100% vested means the balances in the account are available to the employee in the form of rollovers and transfers - should the person leave the company. If the person has not completed a minimum number of years with the The companies plan the employer may deduct non-vested portion of their contributions to the account (the best). Since vesting periods are normally 5 years or so, in the example just cited, the person would only be 20% vested. The rules and circumstances are not all or none, nor should they be. The number of years before having your term completed (per the plan) are simply deducted from the company contributions made to the plan.

If the employee contributed $5000 and the employer contributed $5000 while the person is 20% vested, the amount the company can withhold would be $4000. As only 20% of the company's contribution can be transferred or rolled over to a new plan, whether it is a 401k or other qualified account.

Rules and Regulations

The 401k vesting rules make good market sense and in the end are for the benefit of employees who participate in these plans. If these regulations were not in place, businesses might cut back on the percentages and matching amounts which in the end are a big benefit with 401 k accounts. A company would look to save money somewhere and that could come from scaled back contribution amounts, plan choices or even other areas such as salary and bonus. What Does Vitamin K Do and Why is it Important to Know?

So you have heard about a Vitamin and know you want to know what does Vitamin K do? Well, first let's define what a vitamin is. A Vitamin is a key nutrient that the body needs in small amounts to grow and stay strong. Vitamin K is a fat soluble vitamin (it is stored in the body), available in foods and manufactured by intestinal bacteria.

It consists of a group of compounds called vitamin K1, K2, K3 or K4.



K1 (phylloquinone) is present naturally in plants.

K2 (menaquinone) is made by bacteria in the intestinal tract of humans and animals.

K3 (menadione) is man made.

K4 (menadiol) is man made. It can be used by intestinal bacteria to make K2.

Unlike the fat-soluble compounds K1, K2 and K3, K4 are water-soluble.

So what exactly does Vitamin K do? It protects us from excessive bleeding when we get cut. It protects us when we get hit or are injured to not bleed internally. It is used by the body in the formation of prothrombin and other blood clotting proteins. Vitamin K is also required for the biosynthesis of some proteins found in plasma, bone and kidneys

If you have had a stroke or are high risk for strokes then you may be on a drug called Coumadin (Warfarin) which is known as a blood thinner. If you are on this medication you should avoid blood thickening foods high in Vitamin K. Vitamin K will decrease the action of Coumadin therefore its value as a stroke preventer will be decreased.

Most vitamin K from food sources is obtained from leafy green vegetables (such as those in the accompanying chart) and from four vegetable oils, including olive oil and soybean oil. Beef liver and green tea is also sources of vitamin K.
