How to Manage and Prepare a 501(k) For Clinical Submission

In the last several months, a number of medical device product companies and manufacturers have contacted me with a similar question. The question pertains to approval in Europe, Australia, Japan, Canada and how that relates to a US approval, and secondly, what type of 510(k) to prepare in the US? Is there a fast track to approval in the US since they have device, detection and diagnostic non-US CE Marks of approval to market in non-US countries? There is much debate with IVDMIA status, STED Pilot Programs and LDT clinical submissions, which does not exist with Traditional, Abbreviated and Special 510(k) types of clinical submissions. The answer is to understand and assess where you are, where you want to go, and plan the most expeditious way to get there while conducting activities in accordance with FDA CDRH guidance and requirements. Assess the status of the device, this means to assess the status as it relates not only to guidance and regulatory requirements, but to assess the integrity and quality of data and documentation, statement, label, claim, completeness of application and submission, intended use, omission, missing data and documentation, translation, standard for development and quality review systems, compliance to the Federal Register and otherwise.

Each medical device product will be reviewed according to its intended use and if it relates to an unmet medical need or emergent or life threatening serious need, but beware, these applications are not easily regulated and approved and will be reviewed with regulatory rigor.

Yes, there are 3 types of PMA 510(k)s that may be submitted to FDA, Traditional, Special and Abbreviated. The Special and Abbreviated regulatory paths were developed under "The New 510(k) Paradigm" to help streamline the 510(k) review process at FDA. The Special 510(k) and Abbreviated 510(k) regulatory methods can only be used if certain criteria are met. The Traditional regulatory path can be used under any circumstances. Information required at the time of filing can be found in 21 CFR 807 Subpart E.

A 510(k) PMA Notification does not require a "form" to complete for submission. There is no form. The 510(k) concept is based on substantial equivalence (SE) to a legally marketed (predicate) device(s). All 510(k)s must provide a comparison between the device to be marketed and the predicate device or devices already marketed.

A most important consideration is the predicate device. A company must identify a predicate device as a component of their clinical submission. That predicate device will be used as a source comparison to your device at the time of clinical submission and regulatory review. The choice of the predicate device is crucial and I strongly recommend that the 501(k) number of the predicate device be identified in the clinical submission - be transparent, be clear, be open. Choose a device for your comparator that is similar to your device. You may claim SE to more than one predicate. The predicate device of choice will and must be recently cleared and approved by FDA. There is additional guidance at the FDA website pertaining to "How to Find a Predicate Device".

The K-T Mass Extinction Was Caused by a Meteorite Impact

In the late 1970's Walter and Luis Alvarez discovered an unexplainably high level of iridium at the K-T boundary at Gubbio, Italy. The level of iridium at this location was 30 times higher than in the other layers of rock, below and above the boundary. The Alvarez team claimed that some 65 Ma ago, the earth was impacted by a celestial body, probably a meteorite, which was responsible for the high iridium level.

One theory put forward was that the boundary could have been formed by sediment accumulating 30 times more slowly than normal. However, since the discovery by the Alvarez team, further discoveries in other parts of the world, at the K-T boundary, which all show iridium concentrations of 30 times the norm, ruled out the slow sedimentation theory.

Massive celestial objects traveling at great speeds would have high kinetic energy, and if they hit the earth, which they do quickly, the rate of energy conversion would be enormous. The impact would have excavated rock, provided intense heat, which would melt the rock and spray it as lava into the atmosphere. Tsunamis would also occur at the point of impact, or points of impact, if more than one piece of meteorite hit the earth at that one time, which has been suggested.

Evidence supporting the impact theory includes the following:

1. The iridium excess in the 65 My-old soil layer has been confirmed at many points around the world.

2. The same soil layer contains grains of quartz that were deformed by high shock pressures, as would occur in a giant explosion. (The deformation is a microscopic structure called "twinning," in the crystals).

3. There are occasional minute diamonds formed under extreme high pressures.

4. Tiny glass spheres were formed as chilled droplets of molten rock were ejected into the atmosphere.

5. The same soil layer contains enough soot to correspond to burning down all of the forests of the world. This suggests that massive fires were touched off at the time of impact.

6. The same soil layer, especially around the Gulf of Mexico, contains massive deposits of tumbled boulders, as would be generated in a large tsunami, or "tidal wave." The geographic distribution of tsunami deposits suggest the impact was in the Caribbean area.

7. After a decade of searching, scientists in 1990 identified the crater associated with this material. It is no longer visible on the surface of the Earth, but is buried under sediments. It straddles the coast of Yucatan, in the Mexican province of Chicxulub. It was revealed by mapping the strength of the gravity field over that area, and by drilling; it has been dated to 65 Ma old. It was identified as an impact crater.

8. Astronomers have charted numerous asteroids that cross Earth's orbit. From studies of orbit statistics, it is estimated that asteroids of 10 km size can hit the earth roughly every 100 My or so -- which fits with the idea that we actually did get hit 65 My ago by an object this size. (Smaller hits are much more common).

9. At the K-T boundaries throughout the world, there is a rich variety of fossilised plankton below the boundary (older than 65 Ma), but very few fossils at the layer, giving further evidence to mass extinction at that time.

Another cause of the K-T boundary and mass extinction has been suggested, rather than the impact theory. That of flood basalts. Detailed radiometric testing has revealed that large magma flows occurred either side of the K-T boundary. It was the result of India drifting over a hot spot, during continental drift. The vast amounts of pyroclastic material and gases emitted by the flood basalts would have caused a significant extinction of many species of life. Sulphur dioxide would have given rise to acidic rain, which would decrease the Ph of ocean surface water. Carbon dioxide released during this event would cause global warming. The dust released by the activity would increase the Earth's albedo and result in cooling. Sulphur dioxide, carbon dioxide and dust affect the atmosphere and so would spread around the earth quickly, a prerequisite for mass extinction. Foraminifera, with their calcium carbonate shells, would not have survived in the acidic conditions of the sea. The dust would have prevented photosynthesis of phytoplankton, which would become extinct and would no longer be a food chain item for higher life forms, which would also die out.

Do I expect to be working in my retirement years? If you believe that you will, you have a high chance of being in the same tax bracket or higher than you are now. If the answer is no, likely your income will be lower.


Will the political landscape shift towards higher tax rates? It is easy to speculate that with the expected budget deficits, tax rates will go up, and that favors the Roth IRA. If you believe they will decline, that would favor the 401(k).

If your employer offers 401(k) matching, always max it out. This is free money.

The question really revolves around what to do with additional retirement money. Given all the above factors, and also assuming you're young and have many years of income growth ahead of you, a great option is a Roth IRA.

Preparing for a 5K

Throughout my experience of running marathons, triathlons, and small 5&10K races, I found that the beneficial and enjoyable races were my local 5k's. If you've ever thought about running one I highly suggest getting out there trying it. Here are a few helpful hints on preparing yourself for one.

1. Sign Up, Already

Chances are, no matter where you live, there's a 5-K nearby soon. It's the most popular race: 7,500-plus 5-Ks held in 2006 drew more than 3 million runners. Why? "It's only three miles!" Well, 3.1 miles, but so as long as you're logging three half-hour runs per week, you can complete a 5-K this weekend. And you can run a fast 5-K with as little as six weeks of concentrated training.

2. Just Have Fun

5-Ks are a great way to meet people and stay in good shape and they're newbie-friendly. I would have to admit that I was a little afraid that the veteran racers would be annoyed with a newbie. The opposite was true; the local running group cheered me on. If you're used to looking at your watch, try ignoring it during your next race. I did that in two 5-Ks this fall and set new personal records each time.

3. Use 5-Ks for Speed

Runners training for a longer event, like a half or full marathon, can use 5-Ks in place of speed work. I primarily use 5k's to race into shape, this has helped me complete 114 5-K Races for the Cure. I usually tend to run a little slower than race pace and for about 20 to 25 minutes, here's how I prepare myself for a local 5-K:

MON: Rest day

TUE: Speed session

WED: Easy run, longer distance, or rest day

THU: Speed session

FRI: Rest day or easy run with last half mile at race pace

SAT: 5-K race

SUN: Easy run, mid-distance

4. Eat a Little

You don't need additional calories before you run a 5-K, but if you're used to eating breakfast, you might feel hungry. Your body needs some calories to help you wake up and keep going, but don't overdo it. I suggest just half a bagel with peanut butter, half a banana, or gel/sports beans/shot blocks is enough. Also a little tip for the newbie's trying their first 5k, there is no reason to eat before a 5-K, as they all have real food afterward.

Timothy's World K-Cup Coffee Review

I thought that Timothy's World K-Cup Coffee is just one of those brands that do not really live up to their claim of good old smooth and flavorful coffee. I am still sampling on different k-cups and this one doesn't really fail to impress me every time.
 
I received a Keurig coffee maker with Timothy's coffee pods from my fiancé on my last birthday and I have been using it everyday since I got it. This particular k-cup made me save a lot of money by preventing me on my daily walk to nearby local coffee houses.

The coffee is medium roast, very pleasant and non acidic. It is very smooth, mellow and very distinct; perfect when you want to just chill and relax while reading a good book or having a good conversation.

My fiancé was never a fan of weak coffee or strong coffee and we were both surprised that this one hit him like a surprise. He said that the World K-Cup has the perfect blend of balance. His palate seems to be satisfied every time he drinks a cup.

As for my take, I do like my coffee strong and bold but Timothy's World K-Cup Coffee seems to make me want to shift from strong blend to medium blend. Increasing Your 401(K) Contributions From $16,500 To $250,000 Per Year

Did you know that if you design your 401(K) plan a certain way, you can increase how much deferred income you can invest into your retirement savings plan. Well, I am going to provide you with some very exciting information, but before I do that I wanted to touch on a little bit about our future retirement situatation. Our nation is on the verge of losing social security and it is imperative today to start thinking about how we are going to finance our retirement without it. Now most of us know that social security was actually formed to be a supplement to our retirement and not our main resource for retirement. We also know that many employers provide 401(K) plans for their employees which assists the employees in planning for their retirement. The name 401(K) is the section of the Internal Revenue Code where as it stipulates that employees can set aside tax deferred income for retirement. Today, we can invest into our 401(K)'s plan up to $16,500.00 per year. This amount is based on ERISA guideline section 402(g) which is the section of the Internal Revenue code that limits contributions into company pension plans. However, there is a catch-up clause for individual participants over the age of 50 to increase their contributions by adding an additional $5,500.00 on top of their $16,500.00 per year contributions. Sounds pretty generous, huh? Well, there is more....

In addition to ERISA section 402(g), which is also known as"Defined Contribution", there is an additional "Profit-Sharing" plan that you can add to your company's Defined Contribution plan. This Profit Sharing arrangement allows for additional funds to go into a separate account under different rules. Rule 2e bases the profit-sharing on either "pro-rata", where an additional contribution will be set aside for each employee based on their compensation or "integrated" with social security, the formula for this may integrate an employees compensation with the social security taxable wage base. The formula results in a larger percentage allocated to eligible employees earning more than the taxable wage base or a certain percentage thereof. Then you have rule 2a which uses either an "age weighted" formula that takes into account each employee's age and compensation. The age weighted formula results in larger allocations of the contributions to employees who are closer to retirement. Additionally, this formula combines the flexibility of a profit sharing plan with the ability of a pension plan to benefit or favor older employees. The second part of 2a is the "new comparability", also referred to as "cross tested plans" where the profit-sharing plan is tested for non-discrimination as though it was a defined benefit plan which allows certain employees to receive much higher allocations than typically permitted by standard nondiscrimination testing because an employer can now determine and define certain groups, each receiving different allocations. New comparability plans are generally utilized by small businesses that want to maximize contributions to owners and higher paid employees while minimizing those for all other employees.

As you can see, there is an amazing opportunity to increase your overall contributions into a retirement savings plan and prepare for a more enriched retirement. Above we discussed the basic defined contribution plan that allows tax deferred savings of up to $16,500 or $22,000 if over the age of fifty, then we added a profit-sharing plan to augment the overall contribution savings and now we are going to delve into a category that is very beneficial to small groups such as doctor groups, attorney groups or highly paid executive groups. By adding a "Defined Benefit" plan or "Cash Balance" to your current 401(K) plan, you can potentially contribute up to a total of $250,000.00 per year on a tax deferred basis. A "Defined Benefit" plan is a separate company retirement plan such as a pension plan whereas the employer will set aside a specific sum of money that will be allocated for retired employees based on the history of the salary and the amount of years the employee provided their employer.
